Search Warrant

A search warrant is the instrument that carries the most legal weight and, correspondingly, the most procedural protection. When one arrives, the question is rarely whether to comply. It is whether the warrant is valid and what its scope actually covers.

What a search warrant requires

Four elements have to be present:

  1. Probable cause, supported by a sworn affidavit.
  2. A neutral magistrate or judge who reviews that affidavit and decides independently whether the standard is met.
  3. Particularity: the warrant must describe specifically the place to be searched and the items to be seized.
  4. Proper issuance and service by an authority with jurisdiction over the recipient.

The neutral-judge requirement is the structural protection. Unlike a subpoena, a warrant is not something an investigator can issue for themselves.

What data a warrant reaches

Under the Stored Communications Act, a warrant is the instrument required to compel the contents of communications: message bodies, stored files, photos, drafts. Everything a subpoena or a § 2703(d) order can reach, a warrant can also reach.

What it means for a company receiving one

Compliance is mandatory, but three review steps still matter and are frequently skipped under time pressure.

  • Check jurisdiction. A warrant issued by a court without authority over your company is not automatically enforceable against you. Cross-border warrants raise this squarely, and the CLOUD Act framework governs much of that terrain.
  • Read the scope narrowly and produce to it. Particularity is a legal requirement, and producing beyond the described scope is a disclosure your users did not have to bear. If the described scope is genuinely ambiguous, the right move is to ask the issuing agency to clarify in writing, not to guess generously.
  • Check for an accompanying non-disclosure order. Whether you may notify the user is a separate legal question from whether you must produce, governed by a separate instrument.

How to validate a warrant

Warrants are forged less often than emergency requests, precisely because they leave a verifiable trail, but forgeries do occur, and the trail is what catches them. A warrant names an issuing court, a judge, and a case number, all of which can be checked against the court directly. The signature and the docket are the artefacts a fraudulent request cannot easily reproduce, and confirming them with the issuing court is the definitive check.

Frequently asked questions

What is probable cause?

Probable cause is a reasonable basis, supported by facts, for believing that a crime has been committed and that evidence of it will be found in the place to be searched. It is a meaningfully higher bar than the relevance standard that supports a subpoena, and a neutral judge rather than the investigator decides whether it is met.

Does a warrant let law enforcement take anything they ask for?

No. A warrant must particularly describe the place to be searched and the things to be seized. A warrant authorising seizure of communications over a defined period does not authorise the entire account history, and a recipient is entitled to produce only what falls inside the described scope.

Can a company tell the user their data was seized under a warrant?

It depends on whether a separate non-disclosure order accompanies the warrant. A warrant alone does not automatically prohibit notice, but in practice one is frequently paired with a court order under 18 U.S.C. § 2705(b) that does. Absent such an order, many providers notify as a matter of policy.
